The Health and Safety at Work Act 2015 (HSWA) came into effect on 4 April 2016 and replaced the Health and Safety in Employment (HSE) Act 1992. HSWA is New Zealand’s primary workplace health and safety law.
Specific requirements are set out for activities or workplaces in regulations under HSWA, such as the Health and Safety at Work (Hazardous Substances) Regulations 2017 for work with hazardous substances. These regulations replace the Hazardous Substances and New Organisms Act 1996 (HSNO) - most requirements take effect from Dec. 1, 2017.
These new regulations sit under the Health and Safety at Work Act 2015 (HSWA). Most requirements and controls carry over from the previous regime, but there are some changes.
For example, Compliance Certifiers (formerly, Test Certifiers) are now managed by WorkSafe NZ, they are required to follow performance standards issued by WorkSafe NZ and undergo regular audits. Some of the documents Compliance Certifiers will look for include:
Documentation for Storage Containers:
- Design Certificate or PS1 Producer Statement for the container
- Bund and foundation design PS1 Producer Statement
- Hydrostatic test certificate
- Certified drawings
- Installation QA documents e.g. Inspection Test Plans (ITPs)
Documentation for Piping and Pressure Vessels:
- Design verification certificate and verified drawings
- Non-destructive test results, including hydrotest certificates
- Installation QA documents e.g. Inspection Test Plans (ITPs)
